Welcome to Journey Beyond (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, application, and related services (collectively, the “Service”).

By accessing or using Journey Beyond, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction (e.g., under 18 in many places), you may use the Service only with consent of a parent or legal guardian who accepts these Terms on your behalf. If you are in the EEA/UK, you must be at least 16 unless local law permits a lower age between 13 and 16 with parental/guardian consent. 2. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for your conduct and for any data, text, audio, or other content you provide.

You must not:

• Violate any applicable law or regulation, or the rights of others (including intellectual property and privacy rights).
• Upload, stream, or transmit content that is unlawful, harmful, violent, harassing, or otherwise objectionable.
• Record, upload, or share audio of third parties without all legally required notices/consents.
• Introduce malware or attempt to disrupt, overload, or interfere with the Service or its infrastructure.
• Scrape, crawl, or access the Service by automated means not expressly permitted; circumvent rate limits or technical controls.
• Reverse-engineer, decompile, or otherwise attempt to derive source code or underlying models, except to the extent such restriction is prohibited by law.

3. User Accounts

Certain features (e.g., recording and transcription) require sign-in with a supported third-party identity provider (e.g., Google). You are responsible for maintaining the security of your credentials and for all activity under your account. Notify us promptly of any suspected compromise.

If you lose access to your third-party identity account, we may be unable to recover your Journey Beyond data. We recommend using the provider’s recovery options and keeping your credentials secure.

You may request deletion of your Journey Beyond account by contacting support@journeybeyond.io. After verifying your request, we will delete your account and associated data in accordance with our Privacy Policy.

We may suspend or terminate your access if you violate these Terms or if your use, in our reasonable judgment, poses a risk to the Service or other users.

4. Content Ownership and License

You retain ownership of the original content you create or submit while using the Service (e.g., voice recordings, narration, session notes) (“User Content”).

To operate and improve the Service, you grant Journey Beyond a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, process, analyze, reproduce, modify, adapt, transmit, perform, display, and stream your User Content as reasonably necessary to provide, maintain, protect, and enhance the Service and develop new features.

We may create and use de-identified and/or aggregated data derived from your use of the Service for analytics, product improvement, and reporting. Such data will not identify you personally. Any optional promotional use of User Content will be subject to your prior consent.

You are responsible for ensuring you have all rights, licenses, and permissions needed for any third-party content you upload, stream, or incorporate. We do not claim ownership of your User Content.

Feedback. If you provide ideas, suggestions, or feedback, you grant Journey Beyond a perpetual, irrevocable, worldwide, royalty-free license to use it without restriction or obligation to you.

Takedowns. We may remove content (or suspend accounts) that we reasonably believe violates these Terms or third-party rights, and we will respond to proper notices of alleged infringement in accordance with applicable law.

5. Music Usage and Licensing

The Service provides access to music and audio made available by Journey Beyond and its licensors (“JB Audio”). JB Audio is licensed for playback through the Service only.

• No extraction or redistribution. You may not download, rip, isolate, resell, sublicense, or otherwise use JB Audio outside the Service without prior written permission.
• Streaming and recordings. You may include JB Audio in live or recorded sessions (e.g., actual-play streams) only when the audio is played via the Service during the session. You may not re-upload JB Audio as standalone tracks or soundbeds.
• Attribution. Where reasonably practicable, you agree to credit “Journey Beyond” (and composers if listed in-app). Additional attribution terms may be posted in our Licensing FAQ.
• Rights reserved. All rights in JB Audio are owned by Journey Beyond or its licensors. We may request removal of content that uses JB Audio in violation of these Terms.

6. Modifications and Termination

We may modify, suspend, or discontinue the Service (in whole or in part) at any time. We may also update these Terms from time to time. For material changes, we will provide notice (e.g., in-app or email). Your continued use after changes take effect constitutes acceptance of the updated Terms.

We may suspend or terminate your access if you breach these Terms, misuse the Service, or if your use poses risk to the Service or others. You may stop using the Service at any time and may request account deletion per our Privacy Policy.

Upon termination, your right to use the Service ceases, but provisions that by their nature should survive (e.g., ownership, feedback license, disclaimers, limitations of liability, indemnity, governing law, and dispute terms) will continue to apply.

7. Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. Unless expressly set out in a separate Service Level Agreement (SLA) applicable to certain paid tiers, no uptime commitment is provided.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, Journey Beyond will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

In no event will our total liability for all claims relating to the Service exceed the greater of (a) the amounts you paid to us for the Service in the twelve (12) months before the event giving rise to liability or (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations; to the extent those laws apply, some limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Journey Beyond and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your User Content; (ii) your use or misuse of the Service; (iii) your violation of these Terms; or (iv) your violation of applicable law or any third-party rights (including intellectual property and privacy rights). We may, at our expense, assume exclusive defense and control of any matter otherwise subject to indemnification, and you agree to cooperate with our defense.

10. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. You and Journey Beyond agree that the state and federal courts located in Boston, Massachusetts will have exclusive jurisdiction and venue over any dispute arising out of or relating to these Terms or the Service, and you consent to the personal jurisdiction of those courts.
